Ross's Auctioneers & Valuers ("Ross's", "we", "us") is committed to protecting the privacy of your personal information. This policy explains what personal information we collect, why we collect it, how we use, store and disclose it, and how you can access or correct it.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) it contains.
This Privacy Policy forms part of the Ross's Online User Agreement. By using the Ross's Online website ("Site"), registering as a Ross's member, or bidding on or purchasing items, you consent to the collection and use of your personal information in accordance with this policy. Where we collect sensitive information (such as biometric information for identity verification), we will ask for your express consent at the time of collection.
We may amend or update this Privacy Policy from time to time. Changes take effect when published on the Site, so please review this policy periodically.
Information Collection and Use
Ross's collects information from you and about you so that we can run our day-to-day operations and provide our services. This includes processing bids and purchases, processing payments, processing returns (if available), advising you of the status of your bids, communicating with you, preventing fraud, and complying with the law.
Before bidding on or purchasing any item on the Site, you must be registered as a Ross's member. The registration form may ask for information including, but not limited to, your name and contact details, billing information, credit card details, demographic information, and your preferences for particular types of auctions or goods.
If you are a buyer or winning bidder, we also collect information about your use of the Site and the Ross's Online service, including the relevant item, price, time, quantity and payment details.
Any correspondence between you and Ross's will generally be kept and associated with your Ross's membership.
Ross's may also collect information about how you access and use the Site, including but not limited to your IP address, your service provider, the content you view, time spent on the Site, cookies, browser type, websites you visited immediately before or after the Site, and links on the Site you click.
By looking at your use of the Site, your bidding and purchase history, and other information such as your demographic data and purchasing preferences, we aim to tailor the Site to your prior use and preferences. This helps us send you relevant information about specific items, upcoming auctions and offers, or ask for your feedback.
We may use the information we collect, particularly your IP address, to work out where you are accessing the Site from, confirm your identity, validate bids and purchases, and follow up on payments. This helps Ross's reduce identity misuse, security misuse and fraud.
Ross's will ask for your consent before obtaining any non-publicly available information about you from a third party, except for identity verification that you initiate as described below.
We will use our best and reasonable endeavours to make sure you do not receive unsolicited mail that does not match your specified preferences. You can change your preferences and opt out of certain communications or promotional materials by updating your details in your Ross's Online membership. If you still receive correspondence or promotional offers from us that do not match your preferences, please contact us and we will investigate straight away.
Links on the Site to other websites are not necessarily operated by Ross's. Those websites may have their own user agreements and privacy policies, which you should read.
Identity Verification (Premium Bidding)
To bid in Premium Bidding auctions, you must verify your identity. This protects buyers, sellers and consignors from fraud on high-value lots. Standard bidding [does not require / also requires] identity verification.
Identity verification is carried out by our service provider, Didit (Didit Identity, Inc. and its related company Didit Identity Spain, S.L.). When you verify your identity, the following may be collected:
- images of your identity document (such as a driver licence or passport) and the details on it, including your name, date of birth, document number, address and photograph;
- a selfie or short video of your face, used to confirm you are a real person present at the time ("liveness") and that you match the photo on your document; and
- information about the device and network you use, such as your IP address and approximate location.
Biometric information
Face images and the biometric templates created from them are sensitive information under the Privacy Act. We only collect them with your express consent, which we will ask for before verification begins, and we only use them to verify your identity and prevent fraud. We do not use them for marketing or any other purpose.
Ross's receives the result of the verification (for example, verified or not verified) along with the identity details needed to confirm your membership. If you do not want to verify your identity, you can still use the parts of the Site that do not require it, but you will not be able to take part in Premium Bidding.
Overseas Disclosure of Personal Information
Some of our service providers store or process personal information outside Australia. In particular, identity verification information collected by Didit is stored and processed in the European Union (Spain) and may be accessed from or processed in the United States.
Before disclosing personal information overseas, we take reasonable steps to make sure the recipient handles it in a manner consistent with the APPs. These steps include written contractual obligations covering security, confidentiality and data retention. Our identity verification provider holds independent SOC 2 Type 2 and ISO/IEC 27001 security certifications and encrypts personal information both when stored and when sent.
Information held overseas may be subject to the laws of the country where it is held, which may include laws that allow government authorities to access it. Ross's remains accountable under the Privacy Act for how our overseas service providers handle your personal information.
Security of Information
Where reasonably possible, all online communications with you and all online transmissions of personal information are encrypted. Ross's takes reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. However, we cannot guarantee the absolute security of information sent over the internet, and you communicate with us and use the Site on that basis.
You must keep your user name, password and log-in details confidential at all times. Do not reveal them to anyone else or write them down where another person could access them.
We limit access to personal information to staff and service providers who need it to perform their role.
Retention of Personal Information
We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law. Identity verification data held by our verification provider, including document images and biometric information, is kept for 12 months after verification and then deleted.
Membership, transaction and payment records are kept for 7 years to meet our legal and tax obligations.
When personal information is no longer needed, we take reasonable steps to destroy or de-identify it.
Disclosure of Personal Information
When you bid on an item, no personal identifiers are displayed on the Site or visible to other users. Instead, the system generates a bidder number for each auction to identify each buyer. This helps bidders keep track of their bids.
Where required or authorised by law, or where needed to provide our services, your personal information may be disclosed to:
- service providers we use in running our day-to-day business, including our identity verification provider;
- the vendor of the relevant goods;
- a third party that processes, receives or enforces payment;
- a third party that arranges delivery to you; and
- law enforcement or regulatory authorities where required or authorised by law.
Updating and Correcting Your Personal Information
Ross's will use its best endeavours to ensure that information collected about you is accurate, complete and up to date. So that we can keep our records up to date, we request that you review your user information every time you log on or use the Site and that you make the necessary changes to this information immediately.
If you believe that Ross's is holding incorrect information about you then you should contact us and we will make reasonable attempts to verify the accuracy of our information, and where relevant update or correct the information we hold about you.
If you believe that Ross's has not dealt with your personal information in a manner consistent with the Privacy Act 1988 then you should contact us to address your concerns and to discuss how we may better deal with your personal information.
If you wish to access the personal information that we hold about you then you should make a request to us in writing. We will reasonably try and comply with your request, however, your request may be declined for certain reasons and if this is the case then we will provide you with reasons for that denial.
You may also ask us to close your membership and delete your personal information, including your identity verification data. We will do so unless we are required by law to keep certain records

If you believe Ross's has not handled your personal information in line with the Privacy Act or the APPs, please contact us in writing using the details below. We will acknowledge your complaint promptly and aim to respond within 30 days.
